Official Rules:
All entries must be complete with your legal name, zip code, and email address. Sponsor bears no responsibility for lost, late, incomplete, stolen, misdirected, or illegible entries or email; or for any computer, telephone, cable, network, electronic, or internet hardware or software malfunctions, failures, connections, availability, traffic congestion, or technical failures, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the e-mail account. By registering you agree that you would like to receive information about Super Warehouse and its affiliated partners. You may opt-out of the receipt of such information at anytime by following the instructions here. Your opt-out status will not affect your participation or chances of winning in this sweepstakes. Please note that it may take up to 5 business days for your election to opt-out to become effective. Drawing and Prize Redemption: The winner will be selected in a random drawing on or about the following date Jan 7, 2010 from the aggregate of all eligible entries submitted during the Promotional Period. Odds of winning depend on number of entries received (approximately 1 out of 5,000). Limit one prize per person. Awarding of prizes will be conducted by Sponsor, whose decisions are final on all matters relating to this Sweepstakes. Sponsor will notify the winner via e-mail. If the winner cannot be contacted or the winner fails to provide his/her mailing address by reply e-mail within 72 hours of notification, an alternate winner will be selected from the remaining eligible entries. Any prize notification or prize returned as undeliverable will be forfeited and awarded to an alternate winner. Prize will be mailed to the U.S. mailing address provided by the winner. Winner will be required to complete, execute, and return and Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release within 10 business days of notification. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, or if winner is found not to be eligible or not in compliance with these Official Rules, disqualification will result. By accepting prize, where permitted by law, winners grant to Sponsor and/or its affiliates the right to use and publish his/her name, portrait, picture, voice and likeness for advertising, trade and promotional purposes without additional consideration, worldwide, and on the World Wide Web, without notification, review or approval. Further, participants release and agree to hold harmless Sponsor, its parents, affiliates, subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Sweepstakes related activity, or participation in this Sweepstakes. Drawing governed by laws of United States. Any claims relating to this Sweepstakes must be resolved in the United States. Limitations of Liability: Sponsor is not responsible for technical failures in entry transmission. Sponsor is not responsible for any damage to participant's computer occasioned by participation in this Sweepstakes or downloading any information necessary to participate in this Sweepstakes. Sponsor, its officers, directors, employees, representatives, agents, and affiliates, shall have no liability and shall be held harmless by winners for any damage, loss or liability to persons or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend part or all of this Sweepstakes should virus, bugs, unauthorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and select winners from all eligible entries received before cancellation. Sponsor and its officers, directors, employees, representatives, agents and affiliates, are not responsible for technical, hardware, software or telephone failures of any kind, lost, interrupted or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users, or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in this Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor reasonably believes to have tampered with the entry process or with the operation of this Sweepstakes, or who is found to be acting in violation of these Official Rules. This Sweepstakes is intended and limited for play in the United States and shall only be construed and evaluated according to United States law. Choice of Law: Except where prohibited, you agree that any and all claims, judgments and awards arising from this Sweepstakes shall be limited to actual out-of-pocket costs incurred, not including attorneys fees, including costs associated with entering this Sweepstakes. By entering this Sweepstakes, you hereby waives all rights to claim punitive, incidental and consequential damages and other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine. Any legal proceeding relating to this Sweepstakes shall be instituted and maintained exclusively in any court of competent jurisdiction in San Diego County.
